PLEASE NOTE THAT I SERVE THE PUBLIC IN SEVERAL DIFFERENT CAPACITIES:

FIRST: I am an elder law attorney, and my firm is DAVID A. LaRUE, ESQ., P.L.L.C. I have practiced in the field of elder law for the last ten years. A person who hires my services to deal with legal and financial issues related to aging can pay for a flat fee service called "COMPREHENSIVE ELDERLY PLANNING" This service includes the following, for a LIFETIME, ONE time, flat fee: A. COUNSEL AND ANALYSIS AND RECOMMENDATION OF A PLAN TO ADDRESS ESTATE, LIFE AND LONG-TERM CARE PLANNING ISSUES; B. ON GOING IMPLEMENTATION OF THE PLANNING (which could include wills, trusts, guardianships, powers of attorney, gifting plans, family agreements, care agreements, etc., as necessary); C.MEDICAID APPLICATION REPRESENTATION; D. FILL THE GAP ASSISTANCE FOR LIFE CARE PLANNING; AND E. LIMITED ESTATE ADMINISTRATION SERVICES (INCLUDING DEALING WITH MEDICAID ESTATE RECOVERY ISSUES). For a flat fee contract, the "COMPREHENSIVE ELDERLY PLANNING" package price is set by me with reference to three factors: 1) whether the services qualify as "advance" planning, "intermediate" planning, or "crisis" planning; 2) Whether we are representing a single person or a couple; 3) The amount of assets we are dealing with.

SECOND: I am a licensed independent insurance agent who, through my agency, FOREST GREEN FINANCIAL & INSURANCE SOLUTIONS, sell safe investments to seniors and those who are planning for retirement. I DO NOT CHARGE FEES TO PERSONS WHO RETAIN ME FOR THESE SERVICES, but I am paid a commission by any insurance company whose product you buy. These "safe" investments are fixed annuities and equity-indexed annuities (EIAs). These annuities have long-term tax-deferred growth potential and NO DOWNSIDE RISK. I use only top-rated companies and will shop for good rates and contracts for you at NO COST.


THIRD: A branch of my insurance agency, ADVANCE LONG-TERM CARE & INSURANCE SOLUTIONS, sells LTC Insurance, which covers the cost of nursing home care or COMPARABLE HOME HEALTH CARE, not covered by Medicare. Again, I DO NOT CHARGE FEES TO PERSONS WHO RETAIN ME FOR THESE SERVICES, but I am paid a commission by any insurance company whose product you buy. I use only top-rated companies and will shop for good rates and contracts for you at NO COST.

FOURTH: I am a representative of AMERICAN REVERSE MORTGAGE CORPORATION, a Florida corporation that sells "reverse equity mortgages" to senior homeowners age 62 and older. A reverse mortgage is a financial product that lets your home pay you a monthly dividend which you can use for any worthwhile purpose. It is a safe, government insured and regulated contract that provides a person a way to get additional tax-free income by tapping the equity in their home. Again, I DO NOT CHARGE FEES TO PERSONS WHO PURCHASE THIS PRODUCT FROM ME, but I am paid a commission by AMERICAN REVERSE MORTGAGE CORPORATION if you get a reverse mortgage from me.

If you retain our legal services (COMPREHENSIVE ELDERLY PLANNING or otherwise), and also purchase an insurance contract or obtain a reverse mortgage through me, I DO NOT REDUCE LEGAL FEES. In fact, I always suggest that a person coming to my office for insurance or other non-legal services/products should seek advice from another elder law attorney before using our legal services. Likewise, I always suggest to a person who has hired my law firm for legal services (COMPREHENSIVE ELDERLY PLANNING or otherwise) that they should seek advice from another insurance agent/reverse mortgage advisor before using my agencies for these products. (See below.)

Please, note, as an inherent part and natural extension of David A. LaRue’s particular elderly planning law practice, he carries a life and health & accident insurance license (OH, WV, PA, VA and NC), and can and does receive part or all of an insurance agent's commission when a life insurance, annuity, or long-term care insurance contract is placed for one of his clients (Insurance implemented through Luttner Financial Group, Ltd. or Forest Green Financial & Insurance Solutions, LLC, or its wholly-owned division, Advance Long-Term Care & Insurance Solutions, an independent Insurance Agency).  However,  this fact should not affect his personal independent judgment as your elder law attorney as to the course or courses of action most beneficial to you as a long-term care plan.  As a matter of practice, Attorney LaRue endeavors to sell or offer to sell insurance products, when, in his independent professional judgment as a legal counselor, a particular insurance product would objectively be recommended by an estate planning or elder law attorney who did not hold insurance licensing.  Attorney LaRue’s objective is primarily to help his clients achieve their estate and long-term care planning goals.  Whether or not an insurance product is sold to you by him or on his recommendation, the law firm of DAVID A. LARUE, ESQ., P.L.L.C.  still charges the same legal fees that  would otherwise be charged to you for the legal work, and does not discount fees to clients who have purchased or will purchase a particular insurance product.

IN THE EVENT THAT YOU EVER BELIEVE, DURING THE COURSE OF OUR FIRM’S REPRESENTATION,  THAT ATTORNEY LARUE’S OR THE FIRM’S INDEPENDENT PROFESSIONAL JUDGMENT AS A LEGAL COUNSELOR IS AFFECTED BY ATTORNEY LARUE’S RIGHT, AS A LICENSED INSURANCE AGENT, TO RECEIVE A COMMISSION UPON THE ISSUANCE OF AN INSURANCE PRODUCT, YOU SHOULD SEEK A SECOND OPINION FROM ANOTHER ELDER LAW ATTORNEY, OR MAY PURCHASE THE RECOMMENDED INSURANCE PRODUCT FROM ANOTHER INSURANCE PROFESSIONAL OTHER THAN THE AGENCY OR AGENCIES, COMPANY OR COMPANIES UTILIZED BY ATTORNEY LaRUE.
