SERVICE ARRANGEMENTS

As an attorney, I have often been required or asked to explain very complex situations and issues to someone in a way that they could understand the most important points.

In fact, I do not think the law gets any more complicated than in my particular area of practice, estate planning and elder law. So, I am really used to explaining complex concepts as clearly and as simply as possible. In 2000, my firm, DAVID A. LaRUE, ESQ., P.L.L.C., developed a special package of legal services designed to provide a unique group of legal services to people who faced the possibility of needing to receive long-term care (either extended home health care services, assisted living, or extended or permanent nursing home placement). We have published materials explaining this special combination of legal services, showing the various prices based on the particular clients need (Ask for our current handout entitled, "WHAT IS THE ATTORNEY FEE FOR LONG-TERM CARE PLANNING?"). However, until now, I have not taken the time to explain the reasons why we have designed the "Comprehensive Elderly Planning Package" in the way we have, and what crucial and sizable benefits using our services through the "Comprehensive Elderly Planning Package" can provide to you and your loved ones that other approaches to providing legal services simply just cannot provide.

First, our "Comprehensive Elderly Planning Package" places a connection between your concerns as you go through the later stages of your life and our particular store of knowledge and expertise.
In other words, we can be with you and your loved ones every step of the way to assist you in making the right choices.

When a client has signed up for our "Comprehensive Elderly Planning Package", my focus for that client becomes the following:

A. How do I help you make certain that you or your loved one receives the highest quality long-term care, whether that care is at home or outside the traditional home setting such as a nursing home or assisted living facility? This, we believe, is the most vital of all goals, for it goes to the very heart of your quality of life in your later years.

B. How do I help you make decisions related to your future life and long-term care planning? For most of our clients and their families, it is a comfort and a relief to realize that they always will have a resource of discerning, experienced, informed, insightful, and objective advisors with them every step of the way.

C. How can I help you protect and preserve the assets you have accumulated during a lifetime of hard work, thrifty behavior, and astute investment decision-making? If you or your loved one is facing nursing home care, whether it is imminent or anticipated, I can work with you through the maze of choices and options to find the best, or often, the most comfortable solution to the asset protection problem created by the need to pay for quality long-term care.

Our "Comprehensive Elderly Planning Package" will allow us to provide services to you in such a way that you will be able to answer several fundamental questions:

A. How can I get the quality care I need and desire, whether at home, in a residential community, an assisted living facility, a child or other loved one's home, or a nursing home?

B. How will financial and health care decisions be made for me if I have become unable to
make them myself?

C. If I lose the ability to take care of myself, how will I make sure my spouse continues to have a good quality of life?

D. Do I have to spend all of my money on the nursing home? Will there be any money left to take care of my spouse, or to pass on to my children?

E. Who can we rely on to help us be certain the decisions to be made are the right ones?

Through our services encompassed in the "Comprehensive Elderly Planning Package", we work with you (and your loved ones, if you want them to be involved), to develop your unique Comprehensive long-term care and life care plan, in order to help you and your family answer other pressing questions, such as:

$ How can I assure my financial security as I get older?

$ What public benefits am I entitled to receive, and what do I have to do to qualify?

$ Are there any veterans programs I or my spouse can utilize now or in the future?

$ What kinds of insurance policies should I have? Should I buy Long-term Care Insurance? Should I join a Medicare HMO? What Medicare Supplement or Medicare Part D (Prescription) policy should I have?

$ How and when should I distribute my assets? Can I save taxes and avoid probate?

A Comprehensive long-term care and life care plan, offered through and as a fundamental part of our "Comprehensive Elderly Planning Package", can provide the road map that allows you to follow through to achieve your care and asset protection goals. And, if changes occur along the way, our services are available every step of the way to help you shift to another road as it becomes necessary.

With our "Comprehensive Elderly Planning Package", you can pay one flat fee for our services. We prefer not to bill clients by the hour for our work, but you can also choose an hourly representation agreement for the "Comprehensive Elderly Planning Package". We have found that most clients and their families do not like hourly billing. We also have seen several problems with piecemeal, flat fee services, and our desire is to make sure that a client does not limit the scope of legal services needed simply because of cost. And, where piecemeal , flat fee services can result in gaps in service, or worse, greater cost in legal services due to the sheer variety and amount of services needed in many situations, our "Comprehensive Elderly Planning Package" takes these concerns into account. The package price with our "Comprehensive Elderly Planning Package" is designed with the understanding that many of the legal counsel and services which may be needed or desirable for the client facing the prospect of entering, or having a spouse or a loved one entering, a nursing home are similar in most cases. And because the essential initial part of the representation is the thinking process that helps you decide your personalized Comprehensive long-term care and life care plan, your particular level of services for your "Comprehensive Elderly Planning Package" with us will be customized to fit your desires and needs. The flat fee for your "Comprehensive Elderly Planning Package" includes
all necessary legal documents to implement your particular "plan of action".

At your first meeting with us (a flat, $175.00 fee, which can be credited to the cost of your "Comprehensive Elderly Planning Package" services), we will be able to determine the fee you would pay and whether you would qualify for our special installment payment option to obtain your "Comprehensive Elderly Planning Package" services. The payment plan will allow clients to implement their customized Comprehensive long-term care and life care plan immediately, while taking as long as a full year to pay for the planning package (Finance Charges do apply with the installment payment option). The benefits of implementing your Comprehensive long-term care and life care plan with my firm's assistance, using the installment payment option, when purchasing Long-Term Care Insurance is not an option, can be strikingly obvious in a given situation.
